Terms of use
Article 1 (Purpose) The purpose of these terms and conditions is to define the methods and procedures for using the inquiry services provided by Brewguru Co., Ltd. (hereinafter referred to as the "Company") on the Lighthill website (hereinafter referred to as the "Website"), as well as the Private Cask services outlined on the Website. Additionally, these terms and conditions specify the rights, obligations, responsibilities, and other necessary matters between the users and the Website.
Article 2 (Definitions of Terms)
The definitions of terms used in these terms and conditions are as follows:
- “Private Cask Service” refers to a service provided by the Company under a contract with liquor wholesalers to supply whiskey that conforms to specific production methods (hereinafter referred to as “Whiskey”). This includes the act of filling casks with spirits and storing them (hereinafter referred to as “Aging”), as well as bottling and packaging the whiskey (hereinafter referred to as “Bottling”).
- “Inquiry Service” refers to a service provided by the Company through the Website, where the Company consults and proposes Private Cask Services tailored to the user’s preferences and provides related consultations to users who wish to partner with the Company.
- “User” refers to individuals, groups, or corporations who view the guidance of Private Cask Services on the Website or use the Inquiry Services.
Article 3 (Effect and Modification of Terms)
- These terms and conditions shall take effect for all users who wish to use the Company’s services.
- The contents of these terms and conditions shall be posted on the Website or otherwise notified to users, and shall take effect when users agree to them and use the Company’s services.
- The Company may modify these terms and conditions if it deems necessary, and any changes will be announced promptly by the method specified in paragraph 2. However, significant changes affecting the users’ rights or obligations will be announced at least 7 days in advance.
Article 4 (Provision of Information, Guidance on Private Cask Service, and Hyperlinks)
- The Company may post announcements it deems appropriate or potentially useful regarding the operation of the Private Cask Service on the site, service screens, SMS, email, etc.
- Any communication or transactions between users and liquor retailers (hereinafter referred to as “Retailers”) via announcements on the service is solely the responsibility of the user and the Retailer. In case of any issues between the user and the Retailer, they must resolve them directly, and the Company bears no responsibility for such issues.
- The Company does not warrant or assume responsibility for transactions users engage in with external webpages linked via hyperlinks.
- The Company assumes no responsibility for transactions between users and third parties, nor for the benefits users expect from using the Company’s services.
Article 5 (Use of Inquiry Service)
- The Inquiry Service is established by users fully understanding the contents of these terms and conditions and applying through the specified form on the Website by providing their name, contact information, etc.
- The contents of the Inquiry Service do not bind the Company or users in the context of the Private Cask Service.
Article 6 (Consent to Use of Personal Information)
- The Company endeavors to protect users’ personal information as prescribed by relevant laws such as the Personal Information Protection Act and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
- The protection and use of personal information are governed by relevant laws and the Company’s Privacy Policy on the Website. However, the Privacy Policy does not apply to external webpages linked via hyperlinks.
- Personal information provided by users in the Inquiry Service is used, managed, and protected as follows:
- Use of Personal Information: The Company does not disclose or distribute users’ personal information collected in connection with the Inquiry Service to third parties without the user’s consent, except in cases required by law or for crime investigations or other legal procedures.
- Management of Personal Information: Users can request the Company to modify or delete their personal information for protection and management purposes.
- Protection of Personal Information: Users’ personal information cannot be viewed, modified, or deleted by third parties.
Article 7 (Use of Private Cask Service)
- The Private Cask Service is established when users, fully understanding these terms and conditions, enter into a related contract with a Retailer.
- Users eligible to use the Private Cask Service include individuals, groups, and corporations legally authorized to purchase alcohol.
- The Company is not directly liable for damages to users in connection with the Private Cask Service.
- The Company is not responsible for delays or failures in performing obligations related to the Private Cask Service due to force majeure events beyond the control of the parties, such as war, riots, nationwide or regional strikes, government actions or regulations, fires, floods, earthquakes, epidemics such as COVID-19, etc.
Article 8 (Company’s Obligations)
- The Company shall comply with relevant laws and these terms and conditions to ensure that users can normally use the Company’s services and shall strive to provide continuous and stable services.
- The Company shall fulfill its duties as a diligent manager by regularly inspecting and maintaining cleanliness of aging casks and whiskey.
Article 9 (Users’ Obligations)
- Users shall not engage in the following activities:
- Using the Inquiry Service by misappropriating others’ information
- Processing, providing, selling, or using information obtained from the Company’s services for commercial purposes, or allowing third parties to use it
- Engaging in illegal activities in violation of relevant laws
- Users shall comply with relevant laws, these terms and conditions, and other guidelines related to the Private Cask Service as provided by the Company and shall not interfere with the Company’s operations.
Article 10 (Jurisdiction)
Any disputes arising from the use of services between the Website and users shall be governed by the laws of South Korea, and the Seoul Central District Court shall have exclusive jurisdiction as the court of first instance for disputes arising from this agreement.
Addendum
(Effective Date) These terms and conditions shall take effect from May 30, 2024.
